Terms and Conditions

These Terms and Conditions govern the provision of services by Atlis Growth (“we”, “us”, “our”) to the client (“you”, “your”). By engaging our services or making payment on any invoice, you agree to be bound by these terms.

1. SERVICES

Atlis Growth provides website design, website optimisation, search engine optimisation (SEO), and digital marketing services for tradies and local service businesses. The exact scope of work will be agreed prior to commencement and may vary depending on your business requirements.

Our services are focused on improving your online presence and generating enquiries. However, outcomes will depend on various external factors including competition, market demand, and search engine algorithms.

2. PAYMENT TERMS

All projects require a deposit prior to commencement. Unless otherwise agreed in writing, a 50% deposit is required before any work begins, with the remaining balance payable prior to final delivery or handover.

Ongoing services, including SEO and maintenance, are billed monthly in advance.

Failure to make payment may result in suspension of services, delayed delivery, or removal of access to completed work. Atlis Growth reserves the right to withhold final files, website access, or transfer of ownership until all outstanding balances have been paid in full.

3. REFUNDS

Deposits are non-refundable once work has commenced. Due to the nature of digital services, completed work is non-refundable.

No refunds are provided for ongoing services that have already been delivered or for billing periods that have commenced.

If a project has not yet started, a refund may be considered at our discretion, subject to any administrative or planning costs already incurred.

4. CANCELLATION

Ongoing services may be cancelled by providing at least fourteen (14) days’ written notice. Cancellation will take effect at the end of the current billing period.

No partial refunds will be issued for the remaining portion of any active billing cycle.

Any work completed up to the date of cancellation remains payable.

5. NO GUARANTEE OF RESULTS

While we apply industry best practices to improve your visibility and performance, Atlis Growth does not guarantee specific outcomes, including but not limited to:

• Number of website visitors
• Number of leads or enquiries
• Timeframes for results

Search engine performance is influenced by factors outside of our control, including algorithm changes and competitor activity.

6. CLIENT RESPONSIBILITIES

You agree to provide all required content, information, approvals, and feedback in a timely manner. This includes text, images, branding materials, and access to relevant accounts where necessary.

Delays in communication or failure to provide required information may impact project timelines, performance, and results. Atlis Growth is not responsible for delays caused by the client.

7. WEBSITE OWNERSHIP AND ACCESS

All website work, designs, and assets remain the property of Atlis Growth until full payment has been received.

Upon final payment, ownership of the website is transferred to the client, excluding any third-party tools, plugins, or licensed components which remain subject to their respective providers.

Where ongoing services are provided, Atlis Growth may retain administrative access to ensure performance, updates, and maintenance.

8. ONGOING SERVICES

Ongoing SEO and optimisation services are continuous in nature and are designed to improve performance over time. These services are not a one-time deliverable and require consistent work to maintain and improve results.

Stopping ongoing services may result in reduced visibility and performance over time.

9. THIRD-PARTY SERVICES

We may use third-party providers for hosting, analytics, plugins, and integrations. While we aim to work with reliable providers, Atlis Growth is not responsible for downtime, outages, or issues caused by third-party services.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Atlis Growth shall not be liable for any direct, indirect, incidental, or consequential loss, including but not limited to:

• Loss of revenue or profits
• Loss of business opportunities
• Data loss
• Website downtime

You acknowledge that digital marketing results are variable and not guaranteed.

11. TERMINATION

Atlis Growth reserves the right to suspend or terminate services immediately if:

• Payments are not made
• These terms are breached
• Communication becomes unreasonably difficult or uncooperative

Any outstanding fees remain payable upon termination.

12. CHANGES TO TERMS

We reserve the right to update or modify these Terms and Conditions at any time. Continued use of our services constitutes acceptance of any updated terms.

13. GOVERNING LAW

These terms are governed by the laws of Western Australia. Any disputes arising shall be subject to the jurisdiction of the courts of Western Australia.
